Bupa Aged Care Class Action
Echo Law has commenced a class action on behalf of residents of Bupa aged care homes between 1 July 2019 and 11 April 2025 who have experienced substandard care.
The class action is based on allegations that Bupa Aged Care Australia has failed to provide residents with the minimum acceptable level of care required under Australian law, at each of its aged care homes. Bupa’s own reporting confirms systemic understaffing.
These are serious failings that impact the safety and quality of life of residents at those homes and the quality of care they are entitled to receive.
We consider that those Bupa aged care residents (or, where those residents have passed away, their estates) are entitled to compensation and that this legal action is an important step towards holding Bupa accountable, and improving the standard of care delivered in Bupa homes.

Why has this case been brought?
The decision to enter residential aged care is rarely an easy one. When a person does enter residential aged care, they deserve to be safe, treated with dignity and provided with high quality care.
However, certain for-profit aged care providers are failing to meet these standards, by failing to provide the levels of staffing and care that are required by law, and that they are specifically funded to provide.
These issues are particularly pronounced at Bupa aged care centres.
Despite the damning findings of the Aged Care Royal Commission in 2019 and subsequent increases in government funding, Bupa’s own reporting confirms that Bupa has continually failed to improve its staffing levels to an acceptable level, or to meet its legal obligations to provide residents in its care with the services to which they are entitled.
Aged care residents have the same rights as any other member of the community, however those rights are all too often ignored. This class action seeks to enforce those rights and ensure that there are consequences for Bupa’s failings.

Allegations
This class action is based on allegations that, from at least 1 July 2019 onwards, Bupa Aged Care failed to provide staffing levels that would meet minimum acceptable standards in each of its aged care homes. By doing so, Bupa has:
breached its contractual obligations to residents; and
breached consumer guarantees under the Australian Consumer Law (ACL), by failing to provide services that are fit for purpose and delivered with due care and skill.
Who can participate in the class action?
If you or your loved one have been a resident in a Bupa aged care home at any time between 1 July 2019 and 11 April 2025, you (or they) may be eligible to participate as a group member in this class action. Where someone who resided in a Bupa aged care home has since passed away, that person’s estate may be eligible to participate in the claim.
This claim has been issued on an “open class” basis. This means if you are eligible, you will automatically be included as a group member in this class action, unless you choose to opt out at a later stage. However, taking the step of registering your claim will help to ensure you are kept up to date with the class action as it progresses.

What is the class action seeking to recover?
The class action will seek compensation for residents at Bupa aged care homes that have delivered substandard care from 1 July 2019 to 11 April 2025.
That compensation is sought to account for the fact that those people have received a lower standard of care than they were legally entitled to, as well as to recognise the concern and distress caused by that inadequate care.
Costs
There are no out of pocket costs to participate in this class action.
This proceeding is supported by third-party litigation funding. This means that you will not have to pay any money out of your own pocket for legal fees or related expenses and you will not be responsible for paying any costs if the class action is unsuccessful.
If the class action is successful and financial compensation is recovered from Bupa, legal costs and a funding commission for the litigation funder will be deducted from the amount of compensation recovered for group members. These costs will never exceed the amount of compensation to which you may otherwise become entitled and will be assessed by the Court to ensure they are fair and reasonable.

This class action has been brought on behalf of group members who were residents in a Bupa aged care facility at any time from 1 July 2019 to 11 April 2025. Accordingly, if you are a family member of a person that was a resident of a Bupa aged care home at any time in the claim period but that person has since passed away, you can register for this class action.
It is not necessary that you are the executor or administrator of the deceased’s estate to register for this class action. However, when the class action reaches the state where individual loss is assessed, we may take steps to confirm the details of the executor or administrator of the deceased estate for the group member you have registered on behalf of.

If you or your loved one stopped residing in a Bupa aged care home before 1 July 2019, unfortunately you or they are not eligible to participate in this class action. Unfortunately, this class action only covers claims on behalf of persons who have been a resident in a Bupa aged care home from 1 July 2019 to 11 April 2025. This is because of the causes of action brought and the time limits that apply to these claims.

There are strong legal protections in place to ensure that residents do not face repercussions for participating in a claim like this one. Under Australian law:
Each recipient of a residential aged care service has the right to full and effective pursuit of their legal and consumer rights.
Aged care providers must not act in a way that is inconsistent with the legal and consumer rights of an aged care resident.
A resident exercising their legal and consumer rights is not a valid reason for treating a resident differently or for asking that resident to leave a residential aged care service.

It is understandable that you may have mixed feelings about being involved in legal action against your aged care home, especially when there are nurses, carers and staff who do their best to provide you or your loved one with compassionate care. Group members can cease to participate in a class action by taking steps to opt out of the class action. This is called the ‘opt out’ process and will occur at a later stage in the proceeding. Group members who have opted out of a class action will not be bound by its outcome. There is nothing you need to do at the moment if you do not wish to participate in this class action.
