Harvey Norman (Extended Warranties) Class Action

Echo Law has commenced a class action on behalf of consumers who were sold an extended warranty at the time they purchased goods from Harvey Norman (including Domayne and Joyce Mayne), either in store or online, between 17 September 2018 and 17 September 2024.

The extended warranties, called Product Care, are sold by Harvey Norman alongside the sale of goods such as televisions, computers and kitchen and laundry products.

The class action is based on allegations that Product Care offered little or no value, because consumers were already guaranteed the same (or greater) rights under the Australian Consumer Law, for free. As such, we consider that Harvey Norman consumers who paid for Product Care should be entitled to compensation.

Who can participate in the class action?

If you purchased a Product Care extended warranty in store or online from Harvey Norman, Domayne or Joyce Mayne, in Australia, between 17 September 2018 and 17 September 2024 you may be eligible to participate as a group member in this class action.

This claim has been issued on an open class basis. This means if you are eligible, you will automatically be included as a group member in this class action, unless you choose to opt out at a later stage. However, your entitlement to any compensation recovered may depend on you taking further steps to register your claim.

 What is the class action seeking to recover?

This class action seeks to claim compensation for everyone who purchased a Product Care extended warranty from a Harvey Norman, Domayne or Joyce Mayne in Australia at any time between 17 September 2018 and 17 September 2024.

Costs

There are no out of pocket costs to participate in the claim. 

You will not have to pay any money out of your own pocket for legal fees or related expenses and you will not be responsible for paying any costs if the class action is unsuccessful. 

If the class action is successful and financial compensation is recovered from Harvey Norman, legal costs and any litigation funder costs payable will be deducted from the amount of compensation recovered for group members. These costs will never exceed the amount of compensation to which you may otherwise become entitled and will be assessed by the Court to ensure any costs deducted are fair and reasonable.

    Extended warranties are often described as offering “additional coverage” to existing manufacturer warranties or guarantees already held by customers under the Australian Consumer Law. Extended warranties will generally offer the repair or replacement of faulty goods, or alternatively they may offer a store credit or refund.

    There are different types of extended warranty products sold at Harvey Norman and they are known as Product Care Replacement Plan, Product Care Repair Plan or Product Care Coffee Plan.

  • Yes, you can still participate even if you have claimed on your extended warranty.

  • If you register, you can provide details about more than one Product Care extended warranty.

  • Yes, you can still participate if your Product Care extended warranty has expired, as long as you purchased it between 17 September 2018 and 17 September 2024.

  • Unfortunately, you are not presently eligible to be part of this class action if your extended warranty was purchased outside of the period between 17 September 2018 and 17 September 2024. This is because, due to statutory time limits, this class action has been brought on behalf of people who purchased an extended warranty at any time in the six years prior to the commencement of the proceeding only.

    If you purchased Product Care more recently than 17 September 2024, we would encourage you to register your details with us even though you fall outside the current claim period. If the claim period is extended in a way that allows you to participate, we can then notify you of this development.

  • Yes, even if you don’t have a receipt or any documents for your Product Care extended warranty but you believe you purchased one between 17 September 2018 and 17 September 2024, we still encourage you to register your interest.

    You may be able to ask Harvey Norman if you have purchased a Product Care extended warranty.

    If you register, you will be given the option to upload any supporting documents, but this is not a requirement.
